1. General
1.1 These Terms & Conditions apply to all services carried out by Black Bear Exterior Cleaning Ltd (“the Company”).
1.2 By accepting a quotation, booking work, or allowing work to commence, the Customer agrees to these Terms & Conditions in full.
1.3 These Terms shall be governed by the laws of England & Wales.
2. Roof Cleaning – Important Risk Acknowledgement
Roof cleaning carries inherent risks due to the age, condition and prior maintenance history of the roof.
2.1 Moss, algae and debris can conceal pre-existing defects including but not limited to:
Cracked or loose tiles
Worn mortar
Perished underlay/felt
Deteriorated flashing
Previous poor repairs
Structural movement
2.2 The removal of moss may expose pre-existing weaknesses that were previously hidden.
2.3 The Company accepts no liability for:
Tiles that move, crack or dislodge due to pre-existing weakness
Leaks resulting from historical deterioration
Underlay failure
Mortar ridge disturbance where mortar is already compromised
Latent defects not visible prior to cleaning
Roofs that have not been maintained for extended periods
2.4 Roof cleaning does not constitute a roofing inspection or repair service unless specifically agreed in writing.
2.5 The Customer confirms they understand that:
Moss can act as temporary compression holding loose tiles in place
Its removal may reveal or expose underlying issues
The Company is not responsible for historical neglect or structural ageing.
3. Pre-Existing Conditions
3.1 The Company is not responsible for damage resulting from:
Age-related wear and tear
Poor installation
Previous contractor workmanship
Structural movement
Weather-related deterioration
Lack of maintenance
3.2 Any damage discovered after cleaning that is determined to be pre-existing shall remain the responsibility of the property owner.
4. Pressure Washing & Surface Cleaning
4.1 Pressure washing may reveal:
Loose pointing
Weak jointing
Surface pitting
Loose slabs or blocks
Existing cracks
4.2 The Company is not liable for:
Re-sanding loss due to weather
Existing loose pointing or grout failure
Surface deterioration due to age or inferior materials
Efflorescence or pre-existing staining
5. Water Ingress Disclaimer
5.1 The Customer acknowledges that exterior cleaning involves the use of water.
5.2 The Company is not liable for water ingress resulting from:
Defective seals
Aged windows/doors
Failed flashing
Compromised roof membrane
Existing building defects
6. Solar Panel Cleaning
6.1 The Company does not accept liability for:
Existing microfractures
Previously damaged seals
Electrical faults unrelated to cleaning
6.2 The Company does not disconnect solar systems. The Customer must ensure system safety prior to cleaning.
7. Access & Safety
7.1 The Customer is responsible for ensuring safe access to the property.
7.2 The Company may refuse to carry out work if:
Access is unsafe
Ground conditions are unsuitable
Work would require unlawful obstruction (e.g., public highway without permit)
8. Insurance & Liability Limitation
8.1 The Company holds Public Liability Insurance.
8.2 Liability, where proven, is limited to:
The value of the work completed
OR
The Company’s insurance cover limit
Whichever is lower.
8.3 The Company shall not be liable for:
Indirect losses
Consequential damage
Loss of income
Internal damage unless proven negligent
9. Damage Reporting
9.1 Any concerns must be reported within 48 hours of completion.
9.2 Failure to report within this timeframe may invalidate any claim.
10. Payment Terms
10.1 Payment is due upon completion unless otherwise agreed in writing.
10.2 Late payments may incur statutory interest under the Late Payment of Commercial Debts Act.
11. Weather
11.1 Work is weather dependent.
11.2 The Company reserves the right to reschedule where conditions are unsafe.
12. Cancellations
12.1 Cancellations within 48 hours of booking may incur a cancellation charge.
